BASS CIRCUS ASHEVILLE – GENERAL ADMISSION EVENT WAIVER, ASSUMPTION OF RISK, AND TERMS OF ENTRY

NOTICE: THIS IS A BINDING LEGAL CONTRACT. BY PURCHASING A TICKET, REGISTERING FOR, ENTERING, OR ATTENDING BASS CIRCUS ASHEVILLE (THE "EVENT"), YOU ARE AGREEING TO ALL TERMS SET FORTH IN THIS AGREEMENT, INCLUDING THE WAIVER OF CERTAIN LEGAL RIGHTS AND ASSUMPTION OF ALL RISKS.

1. PARTIES & SCOPE

This Event Admission, Guest Liability Waiver, and Terms & Conditions Agreement (the "Agreement") is entered into by and between Rat Lazer Productions LLC, its owners, officers, members, directors, employees, volunteers, agents, and representatives (collectively, "Producer"), The Mule / The Mule Asheville LLC, its property owners, landlords, operators, and staff (collectively, "Venue"), and the ticket holder, purchaser, guest, or attendee (collectively, "Attendee"). This Agreement governs all entry, presence, and participation in activities at the Venue on November 28, 2026.

2. ASSUMPTION OF INHERENT RISKS

Attendee acknowledges that attending a live electronic dance music concert, festival, or public gathering involves inherent, known, and unknown risks to person and property, including but not limited to:

  • Acoustic & Sensory Hazards: Exposure to extremely high-decibel audio systems, sub-bass frequencies, strobe lighting, lasers, theatrical haze, fog machines, and dynamic lighting effects, which may cause temporary or permanent hearing loss, tinnitus, or photo-sensitive epileptic seizures.

  • Physical & Environmental Hazards: Crowding, moshing, dancing, physical exertion, uneven flooring, wet surfaces, stairs, dim lighting, temporary staging structures, outdoor weather, cold temperatures, and interactions with other patrons.

  • Specialized Entertainment Risks: Viewing or proximity to specialized performance arts, including fire spinning, flow arts, aerial acrobatics, pole dancing, and pyrotechnics.

  • Third-Party Conduct: Unpredictable, negligent, or intentional acts of other attendees, staff, performers, or third parties.

Voluntary Assumption: Attendee knowingly, freely, and voluntarily assumes all such risks, whether caused by the negligence of the Producer, Venue, or otherwise, and accepts full personal responsibility for any resulting injury, illness, loss, or damage.

3. RELEASE, WAIVER OF LIABILITY, AND COVENANT NOT TO SUE

To the fullest extent permitted by North Carolina law, Attendee forever RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Rat Lazer Productions LLC, The Mule, and their respective owners, members, officers, employees, volunteers, agents, and sponsors (collectively, the "Released Parties") from any and all liability, claims, demands, losses, damages, or causes of action arising out of or related to personal injury, illness, disability, death, or property damage sustained by Attendee, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

4. INDEMNIFICATION & PROPERTY DAMAGE

Attendee agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or resulting from Attendee's negligent, reckless, or intentional acts, or any damage caused by Attendee to Venue property, staging, sound/lighting gear, or third-party equipment.

5. SECURITY, SEARCHES, AND CODE OF CONDUCT

  • Mandatory Security Screening: Attendee consents to reasonable security searches of their person, bags, clothing, and vehicles upon entry to the Venue. Refusal to submit to a search will result in immediate denial of entry or ejection without refund.

  • Zero-Tolerance Policies: Producer and Venue maintain a strict zero-tolerance policy for violence, fighting, harassment, unauthorized vending, weapons, illegal substances, and unauthorized fire or pyrotechnic props.

  • Right of Ejection: Producer and Venue reserve the right to refuse entry or eject any Attendee who violates Venue rules, appears intoxicated or impaired, or behaves in a disorderly, disruptive, or unsafe manner, without refund or compensation.

6. MEDIA, LIKENESS, AND RECORDING RELEASE

Attendee grants Producer and its authorized media crews the perpetual, worldwide, royalty-free, irrevocable right and license to photograph, film, video record, live stream, and capture Attendee's voice, image, and likeness during the Event. Producer may use such media for promotional, marketing, advertising, or commercial purposes across any platform without compensation or further consent.

7. REFUND POLICY AND FORCE MAJEURE

  • All Sales Final: All ticket sales are final. No refunds, exchanges, or transfers will be issued except as required by law.

  • Force Majeure: Producer and Venue shall not be liable for any failure or delay in performing event obligations due to events beyond their reasonable control, including acts of God, severe weather, natural disasters, utility failures, civil unrest, government orders, or public health emergencies. In the event of cancellation due to force majeure, Producer is not obligated to issue refunds or reschedule.

8. MEDICAL AUTHORIZATION

In the event of a medical emergency, Attendee authorizes Producer and Venue staff to administer first aid and/or secure emergency medical transport (EMS). Attendee assumes full financial responsibility for all medical costs incurred and releases the Released Parties from any liability arising from such medical assistance.

9. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by, construed, and enforced in accordance with the internal laws of the State of North Carolina. Any legal action arising from this Agreement shall be brought exclusively in the state courts located in Buncombe County, North Carolina.

10. Severability & Entire Agreement

If any single provision, clause, or portion of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full legal force and effect. This Agreement constitutes the complete and final understanding regarding event admission and liability.

BY PURCHASING A TICKET OR ENTERING THE VENUE, ATTENDEE ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND FREELY AGREE TO ALL TERMS OF THIS WAIVER AND RELEASE.
